V. Orders & Acceptance

Orders involving:

• Non-standard sizes

• Special configurations

cannot be cancelled once production has commenced, as these products are manufactured specifically to Customer requirements.

Submission of an order does not constitute acceptance until confirmation has been issued by ARISTO.

VI. Delivery & Logistics

Delivery timeframes provided on the website or during the ordering process are estimates only and are subject to change due to operational or external factors.

Delivery is considered complete when:

• Goods are delivered to the Customer’s nominated address, or

• Goods are collected by the Customer or their nominated carrier

Customers are responsible for:

• Providing accurate delivery information

• Ensuring safe and accessible delivery conditions

• Accepting delivery within the agreed timeframe

ARISTO is not liable for delays caused by:

• Freight carriers

• Weather conditions

• Supply chain disruptions

• Other circumstances beyond our reasonable control

VII. Risk & Title

Risk in the Goods transfers to the Customer immediately upon delivery or collection.

From this point, the Customer assumes full responsibility for:

• Storage

• Handling

• Installation

• Insurance of the Goods

Ownership (title) of the Goods remains with ARISTO until full payment has been received and cleared.

Until ownership has passed:

• Goods must not be resold, altered, or encumbered

• ARISTO reserves the right to recover Goods in the event of non-payment

VIII. Consumer Guarantees & Returns

ARISTO complies with the Australian Consumer Law (ACL), which provides Customers with statutory rights that cannot be excluded.

Under the ACL, Customers are entitled to:

• A replacement or refund for a major failure

• Repair or replacement where Goods are not of acceptable quality

Customers must:

• Inspect Goods immediately upon delivery

• Report defects, shortages, or issues within a reasonable timeframe

• Provide supporting evidence such as photos or documentation where required

Returns will only be accepted where:

• Approved by ARISTO in advance

• Goods are deemed defective or non-compliant

Returns will not be accepted for:

• Change of mind

• Incorrect product selection

• Damage caused after delivery

IX. Installation & Regulatory Compliance

ARISTO supplies engineered products designed to meet industry standards; however, we do not provide installation services unless explicitly stated.

The Customer is solely responsible for:

• Ensuring correct installation practices are followed

• Compliance with local building codes and regulations

• Adherence to pool fencing and balustrade safety requirements

ARISTO does not accept responsibility for:

• Non-compliant installations

• Failure to meet regulatory requirements

• Incorrect use of products outside their intended application

Professional consultation is strongly recommended for all structural or safety-critical installations.

X. Glass Handling & Safety Considerations

Glass products require careful handling due to their weight, fragility, and inherent risks.

Customers acknowledge that:

• Improper handling can result in breakage or injury

• Glass panels may be heavy and require multiple persons or mechanical assistance

• Appropriate safety equipment must be used at all times

ARISTO is not liable for:

• Injuries sustained during handling or installation

• Damage caused by improper storage or transport

• Breakages occurring after delivery

XI. Limitation of Liability

To the fullest extent permitted by law, ARISTO shall not be liable for:

• Indirect or consequential losses, including loss of profit or business

• Installation-related issues

• Errors in measurements or specifications provided by the Customer

• Delays or failures caused by third parties

Where liability cannot be excluded, it is limited to:

• The replacement or repair of Goods

• The value of the Goods supplied
